Terms & Conditions

The following terms and conditions apply to the Vimto Love The Taste Promotion (the “Promotion”).

These terms and conditions apply to the Promotion (the “Terms and Conditions”) and shall prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Please retain a copy for your information.

1.         By participating in the Promotion, all claimants of the Promotion (the “Claimants”) agree to be bound by these Terms and Conditions. Claim instructions (inclusive of any short form T&Cs) are deemed to form part of the Terms and Conditions. For the avoidance of doubt, in the event of any contradiction between these terms and conditions and the short form terms and conditions, these terms and conditions shall take precedence. By participating, all Claimants will be deemed to have

(i)        accepted and be bound by the Terms and Conditions, and

(ii)       if under the age of 18, confirmed that they have consent from a parent/guardian to:

a. make a claim as part of the Promotion, and

b. provide all necessary details to receive a refund if their claim is successful.

2.         The Promoter of this Promotion is Nichols plc (t/a Vimto), registered in England with company number 00238303 whose registered office is at Laurel House, 5 Woodlands Park, Ashton Road, Newton-le-Willows, WA12 0HH (the “Promoter”). Please do not send claims to this address. The Promoter’s decision is binding in all matters.

3.         The Promotion runs from 00:01 on 01.04.2024 until 23:59 on 30.06.2024 (the “Promotion Period”). All claims must be submitted by 01.09.2024. Claims submitted outside of this time will not be eligible. Purchase, internet access and a valid PayPal account linked to an English, Scottish or Welsh bank account is required by all Claimants.

4.         During the Promotional Period, the following promotional Vimto products featuring the ‘LOVE THE TASTE’ flash, offer consumers a full refund of the purchase price paid if they don’t ‘Love The Taste’ and comply with these Terms and Conditions.

    • Vimto Sparkling 330ml cans
    • Vimto Sparkling 500ml bottles
    • Vimto Sparkling 2Ltr bottles
    • Vimto Squash 725ml bottles
    • Vimto Squash 1Ltr bottles
    • Vimto Still 500ml bottles

Please note that refunds shall not be offered to consumers in respect of Vimto Still 500ml original bottles, where consumers don’t ‘Love The Taste’ for reasons of (or connected to) the products “containing sugar” or having “misleading labels”.  The Promoter acknowledges that a limited number of promotional bottles have been affected by mislabelling see (Nichols plc recalls Vimto Original because the bottles have been labelled with a ‘No Added Sugar’ statement | Food Standards Agency). Consumers who have purchased any affected products are instead asked to return them to the store from which the products were purchased, and a full refund will be issued by the store upon return.

5.         Making a Claim:

5.1.   Eligibility: This Promotion is open to all residents of England, Scotland and Wales only aged 16 years or over and who have a PayPal account linked to an English, Scottish or Welsh bank account, save for those individuals who are employees of the Promoter, family members of employees of the Promoter, agents of the Promotor, or anyone professionally connected with the administration of the Promotion. The Promoter reserves the right to verify the eligibility of all Claimants and to disqualify any Claimant if they have reasonable grounds to believe the Claimant has breached any of the Terms and Conditions.

5.2. To validly submit a claim, prospective Claimants must:

5.2.1.      purchase any promotional Vimto 500ml, 725ml, 1Ltr or 2Ltr bottle or 330ml can featuring the ‘LOVE THE TASTE’ flash on sale in England, Scotland or Wales (“Qualifying Purchase”);

5.2.2.      scan the QR code found on the bottle/can, or visit www.vimtolovethetaste.co.uk (the “Website”); then

5.2.3.      upload a photo of your original receipt/online purchase clearly showing your Qualifying Purchase dated within the Promotional Period

5.2.4.     upload a photo of the Qualifying Purchase

5.2.5.      tell us why you didn’t love the taste of our product, in no less than 15 words; and

5.2.6.      enter your contact details (full name, and address), and contact email address linked to a PayPal account.

5.3.     Online claims only.

5.4.     There is a maximum of one claim per household during the Promotional Period.

5.5.     A claim is for one product only, regardless of how many products are purchased in the same transaction.

5.6.     Receipts may be used for one claim only.

5.7.     The Promoter takes no responsibility for any claim that is lost, delayed, misdirected, corrupted or incomplete or which cannot be delivered for any technical, system, server or network issue, or any other reason. Claimants who submit a claim on someone else’s behalf may be disqualified.

5.8.     Trade, syndicates, consumer groups and third-party claims will not be accepted. If it becomes apparent that a participant is reposting the same claim content multiple times or using a computer(s) to circumvent this or any other condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s claims will be disqualified, and any refund award will be void.

6.         Claim Approval:

6.1.     Valid claims will be processed following submission on the Website. Successful Claimants will be notified that their claim has been approved via email and a refund will be issued within 28 days of this notification using the contact details they submitted at the time of making their claim.

6.2.     Refunds will be made via PayPal for the amount shown on the proof of purchase, maximum refund value is £2.15 RRP (2Ltr Sparkling). Pricing is at the sole discretion of the retailer.

6.3.     Claimants should retain their receipt as proof of purchase as the Promoter reserves the right to request such proof of purchase as and when they deem necessary.

7.         The Promoter will only process personal information of Claimants as set out below. View our Privacy Policy here. If you participate in this Promotion:

7.1.     The Promoter will temporarily store your following details - full name, house number, street, city, country of residence and email address.

7.2.     The Promoter will store your details on secure servers.

7.3.     Your personal information stored by the Promoter will be deleted during the week commencing 29 December 2024.

7.4.     The Promoter will only use your supplied details for the administration of the Promotion and for no other purpose. You acknowledge and agree that the Promoter may pass such information to its third-party agency solely for the purposes of administering the Promotion. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to customercare@vimto.co.uk. By participating in the Promotion, you agree to the use of your personal data as described here.

7.5.     The Promoter may request that Claimants participate in publicity arising from the Promotion. Claimants are under no obligation to participate and may decline this request. Participation is at Claimants’ discretion and is not a condition of refund acceptance.

8.         In the event of exceptional circumstances outside the reasonable control of the Promoter and only where circumstances make it unavoidable, the Promoter reserves the right to amend, alter or terminate this Promotion at any time but will always endeavour to minimise the effect on the consumer in order to avoid undue disappointment.

9.         The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion, save for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case such liability is limited to the maximum extent permitted by law.

10.      The Promoter reserves the right to verify all claims including but not limited to asking for proof of purchase, address and ID (passport, driving licence or equivalent) which the Claimant must provide within 7 days of a request being made. The Promoter reserves the right to refuse to award a refund and/or refuse further participation in the Promotion and disqualify the prospective Claimant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, the spirit of the Promotion, any instructions forming part of this Promotion’s claim submission requirements or otherwise where a prospective Claimant has participated using fraudulent means.

11.      It is the responsibility of the Claimant to provide correct, up-to-date details when entering the promotion and on acceptance of any refund. The Promoter cannot be held responsible for Claimants failing to supply accurate information which affects their refund acceptance.

12.      The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind relating to the Promotion.

13.      If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

14.      The Promoter’s decision is final with regard to all Promotion matters and no correspondence will be entered into in respect of the same.

15.      Governing Law and Jurisdiction: These Terms and Conditions are governed by the laws of England and Wales. Any claims and/or disputes arising out or in connection with these Terms and Conditions shall be submitted to the exclusive jurisdiction of English Courts unless you live in Scotland or Wales, in which case your local courts will have jurisdiction
